Katsune Kiyumi is the creator and public brand identity behind the Website. This site provides creator information, videos, livestream status and playback options, and links to external platforms.
The Comment Manager information page describes a separate private desktop application for authorized channel management. The Website does not provide its private dashboard, public registration, or access to comment-management records. Nothing on this Website grants visitors administrative access to the creator's channels.
02 / Acceptable use
Use the Website lawfully. Do not interfere with its availability, attempt unauthorized access, impersonate the creator, misuse published contact details, distribute malware, harass others through this site, or infringe the rights of the creator or third parties.
Nothing here prevents legitimate use of information permitted by applicable law, or lawful reporting of security concerns.
03 / Content and commentary
Content may include videos, artwork, livestreams, music-related material, opinions, product evaluations, and other creative work. Commentary and product impressions reflect the creator's actual experience and the context in which they were published; results and opinions may change. Editorial content is not a guarantee of a product's performance or a substitute for professional advice.
Viewing, linking to, or sharing a standard link to content does not transfer ownership or create a licence to commercially reproduce it. Specific permissions can be discussed using the contact email below.
04 / Intellectual property and third-party rights
Creator-owned original content, branding, written works, and other protected materials remain with their respective rights holders. A commissioned artwork or collaborative asset may be displayed under a licence even when its copyright remains with the artist or collaborator; commissioning alone does not automatically transfer copyright.
References to third-party games, characters, music, franchises, platform names, products, marks, and artwork do not claim ownership or imply endorsement or sponsorship. Third-party content remains subject to its own rights and restrictions.
Unless authorized by the relevant rights holder or permitted by law, you may not reproduce, redistribute, sell, modify, impersonate, or commercially exploit protected content solely because it appears on the Website. Nothing in these Terms removes statutory exceptions or other rights provided by applicable copyright law.
05 / YouTube API Services and playback
The Website uses YouTube API Services to retrieve public creator/video metadata and enables playback through YouTube's official player when selected. By using functionality supported by YouTube API Services, you also agree to be bound by YouTube's Terms of Service. Google/YouTube controls video availability, playback, advertising, account features, and platform restrictions.
The Website's public media functions do not sign visitors into Google or post YouTube comments for them. For data handling, see the Privacy Policy and Google's Privacy Policy.
07 / Twitch integration
The Website uses Twitch stream information and may offer Twitch's official player or a link to the channel. Stream states can change after a status check and playback can depend on player size, device support, network conditions, or Twitch availability.

External links may lead to YouTube, Twitch, Discord, X, Instagram, TikTok, Character.AI, or other third parties. These services control their own accounts, features, moderation decisions, terms, and privacy practices. Linking to a destination is not an endorsement of all its users, products, or claims.
09 / Sponsorships, review samples and affiliate relationships
Some content may involve review samples, paid sponsorship, affiliate links, or other material relationships. Such relationships will be disclosed where required in the relevant content or presentation. A general disclosure in these Terms does not replace clear disclosures attached to the particular video, post, or promotion. Reviews and recommendations must reflect the creator's genuine experience and views.
10 / Site availability and technical limitations
Features and integrations can be unavailable due to maintenance, provider changes, service interruptions, or technical limitations. Metadata and livestream status are point-in-time indications and may be delayed or unavailable. Uninterrupted service is not guaranteed.
We do not seek to exclude liability or restrict legal rights that cannot lawfully be excluded or restricted. These terms should not be read as eliminating mandatory consumer, privacy, intellectual-property, or other statutory protections.
11 / Future commissions and purchases
Website-based commission ordering, checkout, and payments are not currently operational. References to possible creative commissions, Character.AI work, lorebooks, or future services are informational only and do not constitute an accepted order, a quote, or a delivery commitment.
Any separately arranged commission remains governed by the written terms agreed for that work. Before website ordering is introduced, relevant pricing, deliverables, intellectual-property licences, revision limits, deposits, cancellations, refunds, timelines, and applicable customer protections must be established and shown in an appropriate acceptance flow.
12 / Limitation of liability and disclaimer of warranties
The Website, its media features, and all creator content are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied.
To the maximum extent permitted by applicable law, Katsune Kiyumi shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill arising out of or related to your access to, use of, or inability to access or use the Website, linked media, or third-party platforms.
13 / Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold harmless Katsune Kiyumi against reasonable, documented losses, liabilities, and legal expenses resulting from third-party claims directly caused by your unlawful conduct, material breach of these Terms of Service, or infringement of applicable intellectual property or privacy rights.
This provision applies only to the extent that such claims and associated losses are directly attributable to your actions. It does not extend to claims arising from the operator’s own negligence or unlawful conduct, nor does it limit any statutory consumer rights that cannot legally be excluded under applicable law.
14 / Governing law and jurisdiction
These Terms of Service and any disputes arising out of or relating to this Website shall be governed by and construed in accordance with the laws of Canada and the applicable local laws of the operator’s jurisdiction of administration, without regard to conflict of law principles.
Any formal legal action, claim, or proceeding arising under or relating to these Terms shall be instituted exclusively in the courts of competent jurisdiction located within Canada, in the judicial district of the operator's principal place of administration.

Changes to these Website Terms do not automatically alter an existing separately negotiated contract, and private staging does not itself establish visitors' or desktop operators' contractual acceptance.
